A “green card” is a term frequently used to refer to obtaining permanent resident status in the United States of America. It is, for the most part, interchangeable with permanent residency.
Parole in Place (PIP) is a special program that allows non-citizen immediate family members of active duty military personnel, or veterans, to apply for their United States Green Card even if they are here illegally and even if they entered without inspection, or EWI. This program allows for the Green Card application to be submitted while the applicant is still present in the US, without having to leave, so as to not create any hardship for the men and women that devote their lives to the service of this country.
Becoming a permanent resident of the United States permits an individual to reside in the United States for the rest of their lives.
The United States issues both immigrant visas and non-immigrant visas. Immigrant visas are sought by persons from other countries who wish to become permanent United States residents.
Family immigration generally involves United States citizens and permanent residents of the United States seeking to sponsor relatives from other countries to obtain immigrant status (permanent residency or green card).
Naturalization is the name we give to the process of becoming a naturalized United States citizen. This usually occurs after the fifth year anniversary of permanent residency, but in some cases it can happen after three years. The process of becoming a naturalized United States citizen is an important one, and confers many benefits. Preparing and filing the application with supporting papers must be done with care and precision. Failure to do so can result in significant delays and other complications. In some less common instances, these complications can be serious.
Windsor v. U.S. was a landmark Supreme Court case, concluding on June 26, 2013, which declared DOMA (Defense of Marriage Act) as unconstitutional under the Fifth Amendment. This decision affords same-sex marriages the same protections as traditional marriages. Same-sex partners who marry may now be sponsored by their U.S. citizen spouse for their Green Card for the first time.
Our office has helped many of the military personnel obtain green cards for their families. I consider it an honor and a particular privilege to be able to help these servicemen and women who sacrifice so much to provide the United States of America it’s security. Questions about getting green cards, permanent residence and visas for their families and family members, which includes wives, children, parents and sisters and brothers, for both immigrant as well as non-immigrant visas, arise frequently for members of the United States military, including United States Army, Navy, Air Force, Marines and Coast Guard.
Rehabilitation Applications are documents used for individuals who have committed crimes or minor violations in the past, and are denied entry to Canada when attempting to enter at the border.
Frequently Asked Questions About Immigration Law in Syracuse, NY
What does an immigration lawyer in Syracuse, NY do?
An experienced Syracuse immigration attorney guides clients through the complex U.S. immigration system. This includes filing petitions for green cards, fiancé(e) visas, adjustment of status, naturalization (citizenship), Parole in Place (PIP), asylum, and more. At Nichols Law Offices, PLLC, we handle everything from initial applications to responding to Requests for Evidence (RFEs) and attending interviews, so you avoid costly mistakes.
How long does it take to get a green card through family sponsorship in New York?
Processing times vary widely. Immediate relatives of U.S. citizens (spouses, unmarried children under 21, and parents) often have shorter waits with no annual quota. Other family categories (such as siblings or married children) may face backlogs depending on visa availability and country of origin. Adjustment of status or consular processing can add several months to years. Contact our Syracuse immigration lawyer early for a realistic timeline based on your specific situation.
Can I apply for U.S. citizenship (naturalization) if I have a green card?
Yes. Most lawful permanent residents can apply for naturalization after five years as a green card holder (or three years if married to and living with a U.S. citizen). You must also meet residency, physical presence, good moral character, and English/civics test requirements. Our firm helps clients prepare strong applications and succeed at the USCIS interview.
What is Parole in Place (PIP) and who qualifies?
Parole in Place is a special program that allows certain undocumented family members of active-duty U.S. military personnel, veterans, or reservists to apply for work authorization and eventually a green card without leaving the country. It prevents separation from loved ones. Nichols Law Offices has extensive experience helping military families in Central New York with Parole in Place applications.
Do I need an immigration attorney for my case, or can I do it myself?
While some simple forms can be filed without help, immigration law is extremely complex and changes frequently. One small error can lead to denial, delays of years, or even removal proceedings. With nearly 30 years of focused experience, our Syracuse immigration attorney provides the attention to detail and strategy needed to build a strong, approvable case.
How much does it cost to hire an immigration lawyer in Syracuse?
Fees depend on the type and complexity of your case. At Nichols Law Offices, PLLC, we offer transparent pricing and flexible payment options. We provide a clear fee quote during your free consultation so you know exactly what to expect. Our goal is to make quality legal help accessible for families in Syracuse, Rome, Utica, Binghamton, Fort Drum, and throughout Central New York.

What should I do if my immigration application is denied?

How long does the citizenship process take in Syracuse, NY?
After filing Form N-400, USCIS processing typically takes 6–12 months on average, though times can vary. This includes biometrics, the interview, and the oath ceremony. Our firm prepares clients thoroughly so they feel confident and increase their chances of approval.
I was injured in a car accident — will this affect my immigration status?
Generally, no. Seeking medical treatment or compensation for injuries does not harm your immigration case. We help injured immigrants pursue personal injury claims while safeguarding their immigration goals. Let us handle both sides so you can focus on healing and your future in the U.S.
